The Constitutional Court approved Tuesday, April 25, a draft law on modification of an article of the Constitution, so that to oblige public functionaries to demonstrate that they own their goods legally.

Deputy Justice Minister Nicolae Esanu, representative of the government to the Constitutional Court, has stated to BASA that the exclusion of this provision "concerning the illicit of property is presumed" from Constitution is needed because the confiscation of illegal revenues in Moldova is applied very seldom because of this sentence.

He noted that "this amendment aims to reduce the corruption and organised crime in Moldova."

"It is true that public functionaries declare their incomes at present as well, but the current legislation does not stipulate the sanctioning or their confiscation if needed be. A person shall assume the obligation to demonstrate how he obtained the goods while exercising of his function, if he decided to become public."

Victor Puscas, chairman of the Constitutional Court of Moldova, has stated to BASA that the approved draft law does not violate the right to property of citizens, stipulated and guarantee by Civil Code.

The draft law on modification of Moldova’s Constitution was worked out by Justice Ministry and backed by chief of state.

The parliament will examine the draft within maximum six months after the Constitutional Court accepts it. // BASA-Press
