Moldova is to pay over 2.5m euros damages in a case lost at ECHR by October
The Moldovan Government’s application to remit the decision passed the European Court of Human Rights (ECHR) in the case of Oferta Plus SRL to the Grand Chamber was rejected. Therefore, Moldova is to pay damages of 2.535,1 million euros to the plaintiff by October 7.
Lawyer Vladislav Gribincea, the plaintiff’s representative at the ECHR, told a news conference on July 15 that the Government tried to delay the payment of damages as it was evident that the Court in Strasbourg will not reexamine the decision that was passed unanimously. Oferta Plus director Cornel Turcanu said that for several times he has been intimidated into withdrawing the application he filed to the ECHR. The police even took legal action against him. Gribincea said that the ECHR is now examining three more cases against Moldova, one of which “Megadat.Com versus Moldova”. If Moldova is found guilty, the Government will have to pay over US$5 million damages in this case. During 1997-1998, the budgetary institutions supplied with electric power by Oferta Plus did not pay for consumption. The economic entity appealed to the European Court after the Ministry of Finance refused to implement a court decision ordering that it pays 20 million lei to the power supplier. So far, the ECHR found Moldova guilty in 123 cases.
